What Is DMCA (Digital Millennium Copyright Act)

Content Ownership

Cameralux respects intellectual property rights and requires all users to do the same.

Content creators, including models, retain ownership of their content. By using the Platform, users grant Cameralux a non-exclusive license to display and distribute such content within the Platform.

Cameralux acts as an intermediary service provider hosting user-generated content and does not pre-screen or actively monitor all content. Cameralux has no actual knowledge of infringement unless properly notified and acts expeditiously upon receipt of valid notices.

Users who repeatedly infringe intellectual property rights may have their accounts suspended or terminated.

Filing a DMCA Notice

If you believe that your content has been used without authorization, you may submit a DMCA Notice to Cameralux.

Your Notice must include:

  • A physical or electronic signature of the rights holder or authorized representative
  • Identification of the copyrighted work
  • Identification of the infringing material and its location
  • Contact information sufficient to reach you
  • A good faith statement that the use is unauthorized
  • A statement under penalty of perjury confirming accuracy

Cameralux reserves the right to reject incomplete or non-compliant notices and may request additional information where necessary.

Platform Response

Upon receiving a valid notice, Cameralux will act expeditiously to remove or disable access to allegedly infringing material.

Cameralux may also:

  • Notify the affected user
  • Request clarification or additional documentation
  • Suspend or terminate accounts in cases of repeated infringement

Cameralux does not make legal determinations regarding the validity of claims and acts in accordance with applicable legal frameworks.

Submitting Notices Independently

Users may submit DMCA Notices independently; however, doing so may expose personal information.

DMCA submissions may become part of public records or legal databases. Cameralux recommends using professional services or designated representatives to minimize privacy risks.

Third-Party Websites

Cameralux does not control or operate third-party websites. Any unauthorized use of content outside the Platform should be addressed directly with the relevant third-party service providers.

Filing a Counter-Notice

If your content has been removed or disabled as a result of a DMCA Notice and you believe this action was taken in error, you may submit a Counter-Notice.

Your Counter-Notice must include:

  • Description and location of removed material
  • Your contact information
  • A statement of good faith belief that the removal was a mistake
  • A statement consenting to the jurisdiction of the courts of England and Wales
  • A statement accepting service of legal process
  • Your signature

Cameralux may restore the content unless the original claimant initiates legal proceedings.

Abuse and Liability

Submitting false, misleading, or fraudulent Notices or Counter-Notices may result in legal liability, including damages, legal costs, and regulatory consequences.

You agree to indemnify and hold harmless Cameralux from any claims arising from your submissions or actions related to copyright enforcement.
